Impeached Judge John Hlophe was successfully nominated to serve on the JSC.
UMKHONTO Wesizwe (MK) party chief whip and impeached Judge John Hlophe has been elected to represent the National Assembly on the Judicial Service Commission (JSC).
The House convened on Tuesday, 9 July to nominate members.
The ANC backed MK’s nomination of Hlophe. The DA contested his nomination, asserting he was unfit for the JSC role.
“It’s neither reasonable nor rational to elect Dr Hlophe as a representative of the National Assembly on the JSC,” said DA chief whip George Michalakis.
He anticipated significant criticism for their vote because Hlophe is an MK party member, and it was MK’s choice to choose their representative for the National Assembly.

Michalakis also argued supporting the notion that if an individual is deemed fit and proper for the National Assembly, they’re similarly suitable to represent the National Assembly in other forums.
“However, in the current context, there are two reasons why this process shouldn’t be followed today. The first is that it’s a matter of public record that Dr Hlophe lost the status as a judge of the High Court in South Africa, as a consequence of a finding of gross misconduct by the Judicial Services Commission,” he said.
“The decision to be taken today is furthermore not merely political, but the exercise of a public power aimed at contributing to the establishment of the very same Judicial Services Commission.”
He emphasised that under these circumstances, it was a legal requirement for the National Assembly to act in a reasonable and rational manner.
The African Christian Democratic Party and Freedom Front Plus supported the DA’s objection to Hlophe.
Other members elected by the National Assembly were ANC MPs Molapi Soviet Lekganyane and Fasiha Hassan, EFF leader Julius Malema, DA’s Glynnis Breytenbach, and ActionSA parliamentary leader Athol Trollip.
