EXPELLED uMkhonto Wesizwe party member Jabulani Khumalo has failed.

This after he attempted to retain control over the bank account of his former political home.

He wanted to remain a signatory to the MK party bank account while he’s appealing his expulsion in the Electoral Court.

The MK party took him to court. The High Court in Pretoria found that even if it was accepted that Khumalo’s challenge in the Electoral Court might succeed, he failed to show any entitlement to be an authorised signatory to the MK party account, whether as president or a member of the party.

“The applicant, in the present matter, established a clear right, such right being a right to access the funds in its bank account,” said acting Judge SJ Myburgh.

The account was frozen because Khumalo refused to give MK party access to it.

“This constitutes an injury actually committed,” said Myburgh.

Khumalo had opened an account with Standard Bank while he was an MK party president.

He was expelled from the party, which is now led by former president Jacob Zuma, in April. The judges said Khumalo adopted an “egregious and obstructive attitude” when dealing with the matter.

“I find that the conduct of the first respondent was unreasonable,” said Myburgh. Khumalo was ordered to pay costs.

MK party spokesman Nhlamulo Ndhlela said Khumalo wanted to hang on to being a signatory to the party’s bank account under the pretext that his expulsion is on appeal.

“This is false because his ill-fated appeal relates only to the issue of the face of the MKP on the ballot paper which has been long overtaken by events,” he said.

He said it’s clear that Khumalo is well funded by enemies of the MK party. 

“He continues to collect punitive cost orders, and we welcome any indirect ANC donations to the coffers as we build the organisation. The MKP will continue to defeat the sellout ANC of Cyril Ramaphosa and its planted agents both in the courts and on the ground until the land and the economy are returned to their rightful owners, the African majority,” Ndhlela said.
